Terms and conditions of sale

Article 1 – Purpose

These general terms and conditions of sale (hereinafter: "GTC") govern the rights and obligations of the parties in connection with the sales offered by Torque Drift School (hereinafter "TORQUE"), an entity developed and managed by ProRace SASU, with its registered office at 11 Impasse Gutenberg, 38110 Rochetoirin, France.
 

Article 2 – General Principle

These GTC apply to all services offered by Torque Drift School: driving courses, track days, and gift cards. Any order implies unconditional acceptance of these GTC.
 

Article 3 – Order Confirmation

Following your order, TORQUE will acknowledge receipt by sending you a confirmation email including a summary of your order, its reference number, and these GTC. The sales contract is deemed concluded at the time of purchase confirmation.
 

Article 4 – Right of Withdrawal

In accordance with Articles L. 121-18 to L. 121-20-1 of the French Consumer Code, the right of withdrawal does not apply to leisure service provisions to be supplied on a specific date or at a specific frequency.
 

Article 5 – Complaints

For any complaint relating to our services, please contact us via our contact form available at: www.torqueschool.com/contact. We are committed to handling your request as promptly as possible.
 

Article 6 – Personal Data Protection

ProRace SASU acknowledges the confidentiality of information provided by the customer at the time of ordering and undertakes not to disclose such information to third parties, in accordance with the GDPR. The customer has the right to access and rectify their personal data.
 

Article 7 – Amendments to the GTC

ProRace SASU reserves the right to amend these GTC. The version in force at the time of the order is the one that applies.
 

Article 8 – Applicable Law and Jurisdiction

French law applies. In the event of a dispute, and in the absence of an amicable resolution, the competent courts of Rochetoirin shall have sole jurisdiction.
 

SECTION 1: DRIVING COURSES

1.1 – Description of the Service

Driving courses are held on certified circuits or suitable venues using specially prepared Nissan 370Z vehicles belonging to Torque Drift School. Services include supervision by BPJEPS-qualified instructors, fuel, vehicle insurance, and meals depending on the package.
 

1.2 – Access Requirements

The participant must hold a valid driving licence (French or recognised foreign licence) or an FFSA licence. The minimum age and specific conditions are specified for each package at the time of booking.
 

1.3 – Payment

Full payment: Payment may be made by bank card, bank transfer, or cash.

Instalment payment: To facilitate your bookings, TORQUE offers instalment payments via our partner Alma, subject to the following conditions:

  • Minimum amount: €250

  • Available for driving courses only

  • Not applicable to gift cards, deposits, or track days

  • Terms (payment schedule, instalments, fees) are indicated at the time of order confirmation

  • The instalment payment agreement is concluded directly between the customer and Alm

Dispute relating to instalment payment: In the event of a dispute with Alma, please contact Alma's customer service in the first instance. Alma is a member of AFEPAME for consumer mediation purposes.
 

1.4 – Customer Cancellation Policy

In the event of cancellation by the customer, refunds are processed according to the following schedule:

  • 60 to 16 days before: 100% refund

  • 15 to 8 days before: 60% refund

  • 7 to 3 days before: no refund

  • No-show on the day: no refund

All cancellations must be made in writing (letter or email). The time of receipt (between 8:00 am and 5:00 pm) determines the refund calculation.

Exception: Submission of a medical certificate attesting to inability to drive, provided within 7 days following the course date, entitles the customer to a refund or rescheduling.

Refund fees: Any refund of a registration paid by bank card is subject to fees of up to €50.

Transferability: The course may be transferred to another person to avoid cancellation penalties.

1.5 – Cancellation by TORQUE

In the event of cancellation due to force majeure (adverse weather conditions, sub-zero temperatures, snow, storm, health restrictions), the customer will be entitled exclusively to a rescheduled date.

1.6 – Customer Responsibilities

The customer undertakes to:

  • Provide valid information at the time of booking

  • Comply with safety instructions and internal regulations

  • Follow the instructions of the instructor pilots

Alcohol: Zero tolerance. TORQUE reserves the right to carry out random checks. A positive test results in immediate cancellation of the course without refund.

Interruption of service: In the event of dangerous driving, intentional misconduct, or failure to comply with safety rules, the instructor may terminate the service without refund.

1.7 – Liability and Insurance

Insurance of TORQUE vehicles: All vehicles used during courses are insured by Torque Drift School. The customer will not be held liable for damage to the vehicle provided safety instructions are followed. Normal wear and tear is borne by TORQUE.

Customer liability: The customer is liable for damage caused by incorrect downshifting or deliberate collision with an obstacle.

Professional Liability Insurance: TORQUE holds Professional Liability insurance covering bodily injury and material damage caused to partner circuits.

SECTION 2: TRACK DAYS

2.1 – Description of the Service

Track days are open driving sessions on certified circuits allowing participants to drive their own vehicles. These sessions are entirely non-competitive, with no rankings or timing.

2.2 – Access Requirements

The participant must:

  • Hold a valid driving licence

  • Have a vehicle in good working order

  • Comply with the circuit's homologation requirements

2.3 – Booking and Deposit

Any booking intended to be paid in cash requires a deposit of 30% of the total amount, payable online at the time of booking (code ACOMPTE30). The balance must be settled no later than on the day of the event by cash or bank card.
 

In the event of cancellation by the customer: the deposit paid is non-refundable and non-transferable, unless otherwise decided by the organiser.

In the event of cancellation by Torque: the deposit may be refunded or transferred to another date.

Instalment payment is not available for track days.

2.4 – Customer Cancellation Policy

The same conditions as for driving courses apply (see Section 1.4).

2.5 – Customer Responsibilities

The participant undertakes to:

  • Provide a vehicle in good technical condition

  • Comply with safety instructions and circuit regulations

  • Drive responsibly on track

Alcohol: Zero tolerance. Random checks possible. Positive test = immediate exclusion without refund.
 

2.6 – Insurance and Liability for Track Days

2.6.1 – Professional Liability Insurance
Torque Drift School holds Professional Liability insurance covering material damage caused to the infrastructure of partner circuits.
 

2.6.2 – Exclusion of Cover – Material Damage Between Participants
Torque Drift School accepts no liability for material damage resulting from impacts or collisions between participants during track days.
 

Material damage caused to vehicles is not covered by TORQUE's insurance. Each participant acknowledges being personally and entirely responsible for:

  • Damage caused to their own vehicle

  • Damage caused to other participants' vehicles

  • Any claims arising therefro

2.6.3 – Personal Liability of the Driver

The participant remains at all times responsible for their conduct on track. In the event of an impact or incident, the participant acknowledges:

  • Being solely responsible for the consequences of their actions

  • Having been informed of the risks associated with motorsport driving

  • Being personally liable for damage caused to third parties

  • Having no recourse against TORQUE for material damage between participants

2.6.4 – Declaration and Acknowledgement By registering for a track day, the participant declares:

  • Having read and understood these provisions

  • Fully accepting the insurance conditions and liability limitations

  • Holding, where applicable, personal insurance covering their motorsport driving activity

SECTION 3: GIFT CARDS

3.1 – Description
Torque Drift School gift cards allow the recipient to be offered a service (driving course or track day).


3.2 – Validity
The gift card is valid for 1 year from the date of purchase. Delivery is made immediately by email to the address provided at the time of ordering.


3.3 – Use
Gift cards may be used as credit to reduce the price of a higher-value service, subject to availability and prior validation.


3.4 – Non-Refundability
Gift cards are non-refundable, except in cases provided for by applicable law.
 

3.5 – Payment
Instalment payment is not available for the purchase of gift cards. Full payment only.
 

SECTION 4: CIRCUIT INTERNAL REGULATIONS

4.1 – Obligation to Comply
The participant undertakes to strictly comply with the internal regulations of the circuit on which the service takes place. Failure to comply with the regulations may result in immediate exclusion without refund.
 

4.2 – Consultation of Specific Regulations
The internal regulations of partner circuits are available at the following addresses:

The participant acknowledges having read the circuit regulations prior to participation and undertakes to comply with them in full.
